Force Majeure

Our obligations under any contract will be suspended for the duration of the Force Majeure event.
We will extend the time to fulfill these obligations by a period equal to the duration of the Force Majeure event.
Genericseva.com may, at its discretion, announce the occurrence of a Force Majeure event on the homepage of its website. However, we are not obligated to do so.

 
The domain name (“Genericseva.com”, “we,” “us”, “Website”, “Platform”), is an internet based portal providing services to all persons (“you,” “yours,” “user”) who access or use the Platform for any reason in accordance with the Terms and Conditions and Privacy Policy set out hereinafter. The Platform is owned and operated by Mehkar Swast Aushahi Seva. If you, the user do not agree to the following terms, do not proceed and use this internet based platform. The use of the genericseva.com platform implies that you have agreed to the all the terms mentioned herein and have entered into a binding agreement with Genericseva.com.
Further, by the implied or expressed acceptance of these Terms and Conditions, you also accept and agree to be bound by our policies, including the privacy policy, and such other rules, guidelines, policies, terms and conditions as are relevant under the applicable law(s) in India and other jurisdictions for the purposes of accessing, browsing or transacting on the Website, or availing any of the Services, and such rules, guidelines, policies, terms and conditions shall be deemed to be incorporated into, and considered as part and parcel of these Terms and Conditions.

To access and use the Services or transact with Third-Party Service Providers through the Genericseva.com Platform, you must complete the registration process as established by Genericseva.com.

Account Usage

However, a registered user who is a parent or legal guardian of a person incompetent to contract (e.g., minors or persons with unsound minds) may use the Platform on their behalf.
Organizations, corporates, and businesses are not permitted to register or use the Platform through individual members or employees.

Through the Genericseva.com Platform, we provide the following services (“Services”):
Advertising, marketing, and delivery of non-prescription drugs, pharmaceutical products, fast-moving consumer goods (FMCG), cosmetics, food products, and private-label products (“Products”).
Sale and Purchase of Products
The sale and purchase of Products on the Genericseva.com Platform are conducted solely by Genericseva (Mehkar Swast Aushadhi Seva).
Genericseva.com may act as a marketplace, connecting buyers and sellers. However, sellers are solely responsible for their products, and buyers cannot hold Genericseva.com liable for any issues related to the products. Genericseva.com’s role is limited to facilitating the marketplace.
By using the Platform, you agree that the Products you purchase are sold by Genericseva.com and are subject to the terms outlined herein.

Your Use of Genericseva.com Services
As a user of the Genericseva.com Platform, you agree to the following terms:
1. Conditions of Due Diligence
You are solely responsible for the medical, health, and personal information you provide on the Platform. Please use discretion when sharing such information.
You must provide accurate and complete information wherever required on the Platform.
You are responsible for maintaining the security and privacy of your account credentials (e.g., password). Any activity conducted under your account is your responsibility.
You are responsible for all information provided by you for the purposes of using the Services, including analysis, research, training, and disclosure (where applicable).
2. Account Access
We reserve the right to refuse access or disconnect your account at our sole discretion if we suspect a violation of applicable laws or these Terms and Conditions.

Scope of Services
Genericseva.com sells Products in various categories, including medicines, generic medicines, medical devices, vitamins, supplements, baby food, personal care products, health food, and over-the-counter medications.
Genericseva.com does not sell drugs listed in Schedule X of the Drugs and Cosmetics Act, 1940.
Products are sold through both online (Genericseva.com Platform) and offline (physical stores) channels. The Platform displays products available in your region based on the PIN code you provide.

Prohibitions
When using the Genericseva.com Platform, you agree not to:
Reproduce, distribute, display, sell, rent, transfer, modify, reverse engineer, disassemble, or manipulate any part of the Platform without express written permission from Genericseva.com.
Assign, transfer, or subcontract any rights or obligations under these Terms or Product Orders to a third party without written consent from Genericseva.com.
Use any information from the Platform for trade purposes without authorization.
Impersonate any person or organization or misrepresent your age, identity, or affiliation.
Upload unauthorized content or content prohibited under applicable laws.
Resell Products purchased from Genericseva.com stores or the Platform without prior approval and authorization from Genericseva.com.

Delivery Rates
Delivery charges for each purchase will be displayed on the payment page when you place an order on the Genericseva.com Platform.
Any additional applicable costs will also be reflected at the time of purchase and reimbursed as per the Genericseva.com Payments, Returns, and Refunds Policy.
Cash on Delivery (COD)
COD is a payment option that allows you to pay for non-medical orders in cash when the courier delivers them to your address.
For medical orders, delivery is handled by Genericseva.com staff.
The COD option is available only in selected locations. If your PIN code is not part of the active COD list, this option will not appear during checkout.
Order Confirmation and Shipping
Genericseva.com will notify you once your order is confirmed and provide updates on the expected delivery time.
We strive to ship each item within 3 working days of the order. However, in some cases, shipping may take longer if the product needs to be sourced from other stores or suppliers.
If we cannot ship your order in full within 7 days, we will cancel the unshipped portion of the order and notify you via email. In such cases, you will receive a refund for the unshipped portion as per the Genericseva.com Payment and Refund Policy.
External Delivery Partners
Genericseva.com uses external delivery partners for certain deliveries, including imported medicines.
Any delay, loss, damage, theft, or issues arising from the shipment of products by external delivery partners are the sole responsibility of the delivery partner. Genericseva.com is not liable for their actions.

Additional Information
Genericseva.com reserves the right to refuse or cancel any orders at its sole discretion, unless the product has already been dispatched.
If a delivery fails due to your mistake or negligence (e.g., incorrect address or information), you will be responsible for any additional costs incurred for redelivery.

Medicine Delivery Policy
A valid prescription from a registered doctor is mandatory for all medicine orders, except where the law permits the dispatch of medicines without a prescription.
You may be required to upload a scanned copy of the prescription on the Genericseva.com Platform.
Your prescription will be reviewed by a registered pharmacist where applicable or necessary under the law. Your order will be confirmed only after the prescription is accepted.
Genericseva.com will record the details of your prescription as required by applicable laws.
You may be required to display the prescription (offline or online) at the time of pickup or delivery for record-keeping purposes.

Prohibited Content
You agree not to upload, distribute, or publish any of the following on the Genericseva.com Platform:
Content that belongs to another person and for which you do not have ownership rights.
Content that is defamatory, abusive, obscene, sexually explicit, invasive of privacy, harassing, discriminatory, or illegal.
Content that promotes hate, discrimination, racism, or violence.
Content related to or promoting money laundering, gambling, or any illegal activity.
Content that harms or exploits children in any way.
Content that infringes on copyrights, trademarks, or other proprietary rights.
Content that violates any applicable laws in India.
Content that is false, misleading, or intended to deceive or harass.
Content that contains viruses or malicious software.
Content that threatens national unity, security, sovereignty, or friendly relations with foreign countries.
Content that instigates crime, obstructs investigations, or insults any nation.
Content unrelated to medical consultation or assistance provided by Genericseva.com.
Consequences of Violations
If you fail to comply with the above restrictions, Genericseva.com reserves the right to:
Remove the prohibited content.
Terminate your access to the Platform and Services.
Take appropriate legal action as deemed necessary.

You acknowledge and agree that Genericseva.com merely provides a marketplace to buyer and seller. All items offered for sale on the Website, and the content made available by the Third Party Sellers, are third party user generated contents and third party products. Genericseva.com has no control over such third party user generated contents products and services and does not – originate or initiate the transmission, or select the sender/recipient of the transmission, or the information contained in such transmission. The authenticity and genuineness of the Products and Services made available by the Third Party Sellers through Genericseva.com shall be the sole responsibility of the Third Party Seller only. You understand and agree that Genericseva.com shall have no liability with respect to the authenticity of the Products and Services being facilitated through its Website.
The commercial terms include without limitation – price, shipping costs, payment methods, payment terms, date, period and mode of delivery, warranties related to Products and Services offered for sale by the Third Party Seller, and after sales services related to such Products and Services are as provided by the Third Party Sellers. Genericseva.com does not have any control over, and does not determine or advise or in any way involve itself in the offering or acceptance of, such commercial terms offered by and agreed to, between you and the Third Party Seller.
You understand and agree that all commercial / contractual terms, with respect to the sale/ purchase/ delivery and consumption of the Products and Services which are offered by and agreed to between You and the Third Party Seller and the contract for purchase of any of the Products and Services, which are offered for sale on the Genericseva.com Website by the Third Party Seller shall strictly be a bipartite contract between the Third Party Seller and You, the Buyer.
BREACH OF CONTRACT 
You accept and acknowledge the following:
Genericseva.com is not responsible for any unsatisfactory performance, delay, non-performance or breach of the agreement entered into between You and the Third Party Sellers for purchase and sale of products or services offered by such Third Party Sellers on the Genericseva.com Website;
Genericseva.com in no manner whatsoever guarantees that the concerned Third Party Sellers will perform any transaction concluded on the Genericseva.com Website;
The Third Party Sellers are solely responsible for ensuring that the Products and Services offered for sale on the Genericseva.com Website are kept in stock for successful fulfilment of orders received. Consequently, Genericseva.com is not responsible if the Third Party Pharmacy(s) does not satisfy the contract for sale of Products and Services which are out of stock, back ordered or otherwise unavailable, but were shown as available on the Website at the time of placement of order by You; and
Genericseva.com shall not and is not required to mediate or resolve any dispute or disagreement between you and Third Party Sellers. In particular, Genericseva.com does not implicitly or explicitly support or endorse the sale or purchase of any items or services on the Genericseva.com Website. Genericseva.com shall, on a request in writing made by you after the purchase of any Products and Services on the Genericseva.com Website, provide you with information regarding the Third Party Sellers from which You have made such purchase, including the registered address of such party along with contact details as maintained in the records of Genericseva.com.
INDEMNITY
By using the Genericseva.com Platform and / or Service, you agree to defend, indemnify and hold harmless Genericseva.com, the Protected Entities, independent contractors, service providers, consultants, licensors, agents, and representatives, and each of their respective directors, officers and employees, from and against any and all claims, losses, liability, damages, and/or costs (including, but not limited to, reasonable attorney fees and costs) arising from or related to:
Your violation of these Terms;

Incorrect or unsupported credit / debit card details provided by you;
Use a credit / debit card that is not legally valid;
Allows third parties to use your password or other means to access your account;
Non-compliance with applicable law or regulation in the area where you have access to the Genericseva.com Platform and / or Service;
Provides counterfeit, counterfeit, unlicensed or used prescription drugs or
Any action taken by Genericseva.com as part of its investigation into alleged breach of these Terms or by reason of its acquisition or decision to make these Terms.

Platform Use and Third-Party Services
Genericseva.com shall not be liable for any issues arising from your use or inability to use the Genericseva.com Platform.
Genericseva.com shall not be liable for your use of any third-party services accessed through the Platform.
Service Disruptions and Errors
Genericseva.com does not guarantee that the Platform, Services, or Products will be free from disruptions, delays, omissions, interruptions, or inaccuracies.
While Genericseva.com takes appropriate measures to prevent viruses, worms, or malicious code, we do not guarantee that the Platform or Services will be free from such harmful features. Genericseva.com is not liable for any damages caused by these features.
